Acquired Brain Injuries 

Generally speaking, the overarching term that is used to refer to all brain injuries, according to the Brain Injury Association of America, is “acquired brain injury,” or ABI. This term refers to “an injury to the brain that is not hereditary, congenital, degenerative, or induced by birth trauma.” Within the very broad and overarching category of the ABI, there are two types of brain injuries that are typically recognized, and those include:

  • Traumatic brain injury (or TBI), which typically occurs as a result of an external force such as a sports-related collision with another athlete or a motor vehicle crash; and
  • Non-traumatic brain injury, which typically happens because of a lack of oxygen to the brain or because of an exposure to certain hazardous substances, which can be due to a medical event like a stroke or a dangerous incident like a near-drowning.

Either type of acquired brain injury may warrant a personal injury lawsuit in Louisiana, depending on the cause. In short, if another party’s negligence or intentional act resulted in either type of brain injury — TBI or non-traumatic brain injury — it may be possible to file a claim to hold that party accountable.

Types of Traumatic Brain Injuries 

Traumatic brain injuries are classified either as:

  • Non-Penetrating or Closed-Head TBIs: This means that there was an external force strong enough to move or rattle the person’s brain within their skull, according to the National Institutes of Health (NIH), but nothing pierced the skull.
  • Penetrating TBIs: This means an external force caused an object to pierce a person’s skull.

Then, TBIs are classified in one of the following three categories: mild (also called a concussion), moderate, and severe. Both penetrating and non-penetrating TBIs can be classified within this range, although penetrating TBIs are more often moderate to severe. For mild TBIs/concussions, the symptoms tend to be less severe or less pronounced than the symptoms of a moderate to severe TBI.
