Case Description:

Our client was a 68-year-old man whose 4th amendment rights were violated by the local police. Law enforcement illegally entered his home and wrongfully arrested him. Thereafter, he suffered severe mental anguish and embarrassment as a result.

Legal Strategy:

Our attorneys had to defeat the government’s qualified immunity by showing that the officer knew his conduct violated our client’s constitutional rights. We ultimately defeated the qualified immunity challenges at the trial court level and even on appeal to the United States Court of Appeals for the Fifth Circuit.

Challenges:

Our client faced conspiracy by the policing agency to manipulate the facts of the arrest. Through the Freedom of Information Act, our attorneys were able to obtain police body cams from all 3 officers involved to disprove the story the police was telling.
