Case Description:

The defendant ran a stop sign, claiming they never saw our client’s car. Unfortunately, the client was not wearing a seat belt, so they were ejected from the vehicle. As a result, the client suffered multiple broken bones and a severe head injury. They were on life support for some months before their eventual death.

Legal Strategy:

Our attorneys obtained nearby surveillance camera footage, which captured the accident and proved that the client was not speeding and that the defendant ran a stop sign.

Challenges:

The defendant completely denied liability and claimed that the client was speeding. The defendant also claimed that had the client worn a seatbelt, they would have only suffered minor injuries. 

Other challenges had to do with the client: they tested positive for alcohol and cocaine at the time of the crash. Further, our client was not wearing a seat belt, and they were driving under a suspended license. Ultimately, we proved that the defendant had actually run the stop sign that caused the wreck.

Resolution:

The case settled $2.15M, representing the insurance policy coverage limits. The settlement was paid to the surviving family members.
