Case Description:
The at-fault Defendant rear-ended our client, causing aggravation of a pre-existing chiari malformation (structural cerebellum malformation). The client required a craniotomy as part of their medical treatment.
Legal Strategy:
We had to prove, through expert medical testimony, that the pre-existing chiari malformation was indeed aggravated by the collision.
Challenges:
The defendant produced an adverse expert medical opinion that the wreck did not cause the injury aggravation. After a four-hour deposition of the defense medical expert, the defendant’s expert eventually agreed to the plaintiff's position on how the injury and symptoms were caused.
Resolution:
Mediated settlement of $2M from the primary insurance carrier and an additional $2M from the excess insurance carrier, for a total of $4M.
